Same-Sex Marriage and Adoption
Currently, because same-sex marriage is not recognized
by the State of Michigan, same-sex couples are not permitted to file for
joint adoption of minors. This means that if you and your same-sex partner
have children together , only one partner will be legally designated as
a parent. Nonetheless, there are ways to plan for some protections for your
children, such as parental delegations and provisions in your last will
and testament.
However, we are anticipating that very soon, same-sex marriage
will be recognized in the State of Michigan. When that occurs, one of the
first things same-sex couples should consider is filing for joint adoption
of their children. This would allow both partners to have a legally recognized
relationship with their child. Some refer to this as second-parent adoption
or step-parent adoption.
