Attorney Fees: Can't my "Ex" pay you?
The answer is maybe. Genesee County has an attorney fee guideline to be used in divorce actions that the judges are encouraged to follow. It is attached on our website for your review. Please note however that it is a GUIDELINE and is not available for post judgment matters or matters which are not divorce related. The Judge does not have to follow the guideline and often may deviate from it. Most attorneys, including our firm, will ask that you pay a certain sum of money up front and will then seek reimbursement from the opposing party. The larger the disparity in income and the longer one is out of the work force, the more likely one will succeed in a request for an award for attorney fees. Please contact our office to discuss in more detail the likelihood of success on a motion for attorney fees in your case.
